A motorcycle accident that took place in Mission Valley earlier this week has proven fatal. ABC San Diego News Channel 10 reports the accident occurred along the ramp that directs traffic from State Route 15 northbound toward Interstate 8 going westbound.
This unfortunate accident occurred around 4 in the afternoon last Thursday. However, the cause of the accident has still yet to be identified. Investigators are trying to figure out why it appears as though a motorcycle slammed into the back of a Honda Civic that was parked at the time of the accident. The Civic was positioned along the shoulder of the ramp when the crash occurred. According to Jim Bettencourt, a public affairs officer, the connecter was closed for several hours as a result of the wreck.
The Response to the Accident
Emergency responders made a beeline to the accident scene. However, the motorcyclist did not survive the crash. Police are still attempting to determine why the Civic was on the side of the onramp and why the motorcyclist did not see the vehicle parked in that position. The California Highway Patrol will continue its investigation of this accident in the days ahead.
The Legal Action to Follow
The bike rider, who has yet to be named, passed away at the accident scene. No additional injuries were reported. The family of the decedent will likely file a wrongful death lawsuit against the driver of the vehicle that was positioned on the connecting ramp. However, proving this driver acted negligently and is fully responsible for the crash will prove challenging as there is an argument to be made that the motorcyclist should have seen the vehicle.
However, if the family’s personal injury attorney invests the proper amount of time and effort in proving the car owner acted negligently, it will be that much easier to obtain financial compensation stemming from a wrongful death lawsuit. If the lawsuit results in a settlement or court award, the money obtained will be used to offset the family’s financial losses, the loss of comfort, the cost of the funeral, the cost of the burial and all other costs causally related to the loss of their loved one.
