A rollover accident that occurred in San Ysidro has proven deadly. ABC San Diego News Channel 10 reports the accident occurred this past Wednesday morning. The crash occurred along the Interstate 805 by San Ysidro Blvd. Early reports state only one vehicle was involved in the accident. Police are now attempting to determine what caused the vehicle to veer off the street and slam into an embankment.
A Closer Look at the Accident
The driver of the vehicle in question was the lone occupant at the time of the crash. He was ejected from the vehicle after hitting the embankment shortly after 3 in the morning. Sadly, this individual was declared dead by emergency responders when they arrived at the accident scene. Police have not yet released information about the driver’s identity or whether he was using his seatbelt at the time of the accident. Furthermore, police have not stated what might have caused the crash as the accident is still under investigation.
Will a Lawsuit be Filed?
It is too early to determine if a lawsuit will be filed. Police are still attempting to determine the cause of the accident. If it turns out another driver failed to provide the victim with due care, his family will file a wrongful death lawsuit. Furthermore, if it appears as through local government failed to take proper care of the road, a wrongful death lawsuit can be filed against that entity.
Even a mechanical issue with the vehicle stemming from a production problem on the assembly line or insufficient maintenance or repair performed by a mechanic sets the stage for a successful wrongful death lawsuit. If the wrongful death lawsuit proves successful, it will lead to either a settlement or a favorable court award. The money obtained through this lawsuit will be used to cover the cost of all related expenses including funeral expenses, burial expenses, the loss of financial support, the loss of comfort and additional losses.
