A Tesla vehicle crashed this past weekend. ABC San Diego News Channel 10 reports the accident occurred in the early morning hours of this past Saturday morning. Early reports state the Tesla smashed through a freeway closure, ultimately rear ending a vehicle.
About the Crash
The driver of the Tesla, a 29-year-old female, was subsequently arrested after the accident on suspicion of driving under the influence of alcohol. This driver was also taken to a nearby hospitals so her injuries could be treated. We are still awaiting word on her condition.
It is particularly interesting to note police were already investigating an auto accident on State Route 56 at the time this crash occurred. According to Officer Salvador Castro with the California Highway Patrol, the Tesla proceeded through a freeway closure before rear-ending another vehicle. The fact that the driver plowed through the freeway closure is a large part of what makes law enforcement assume alcohol might have played a role in the crash.
Will Litigation Follow?
The driver of the Tesla involved in the crash was clearly negligent. Negligence is a legal term that refers to the failure to provide others with the appropriate level of care. The driver drove through a closed freeway and smashed into another automobile. Those injured as a result of the crash can file a personal injury lawsuit against the Tesla driver responsible for the collision. If this lawsuit leads to a settlement or a court award, the money obtained will be used to offset the cost of medical bills, lost wages, diminished earning capacity, pain, suffering and additional losses stemming from the crash. The merit of the plaintiff’s attorney will go a long way in determining whether the lawsuit proves successful. An experienced attorney who has litigated personal injury lawsuits in the past stands a good chance of winning this case.
